Marketplace: The platform ArtGalerie where artists publish and sell their artworks.
Artist (Seller): Any individual or entity that registers to sell artworks on the platform.
Customer (Buyer): Any user who purchases artworks on the platform.
User: Any visitor, artist, or customer accessing the site.
Account: The profile created by users to access specific features of the marketplace.
To use ArtGalerie, you must:
Be at least 18 years old.
Provide accurate, complete, and truthful information.
Have legal capacity to enter into contracts in Brazil.
Artists must additionally comply with any applicable tax and legal obligations related to selling their artwork.
Artists agree to:
Provide correct and verifiable information during account creation.
Publish only original artworks for which they hold full rights.
Set accurate prices, descriptions, and specifications.
Ensure that uploaded images and content do not violate copyrights or third-party rights.
Deliver artworks according to the agreed timeframe (when applicable).
Handle any post-sale support related to the artwork’s authenticity or quality.
ArtGalerie is not responsible for disputes caused by false information or copyright infringements.
Customers agree to:
Provide accurate shipping and payment information.
Review artwork descriptions before purchasing.
Make payments using approved methods.
Fraudulent purchases or chargebacks may result in account suspension and legal action.
ArtGalerie acts as an intermediary between artists and customers.
We are not the owners of the artworks sold and do not produce the items.
Our role includes:
Hosting product listings
Facilitating payments
Providing customer/artist communication channels
We are not responsible for:
The quality or authenticity of artworks
Delays or issues caused by sellers
Loss or damage during shipping (unless we provide shipping)
Payments are processed through third-party payment providers.
By making a purchase or selling artwork, users agree to follow the policies of those providers.
Fees may be applied to transactions. Artists will be informed about applicable seller fees before listing their products.
ArtGalerie may charge a commission on each sale made through the marketplace. The commission percentage will be displayed to artists before each transaction.
Shipping policies vary depending on the artist.
Artists are responsible for:
Packaging
Shipping timelines
Providing tracking information (when applicable)
ArtGalerie may offer shipping solutions, but unless explicitly stated, shipping is the artist’s responsibility.
All artworks listed remain the intellectual property of the artists.
Users agree not to copy, reproduce, redistribute, or use any artwork or images from the platform without permission.
The ArtGalerie name, logo, brand, and website design are the intellectual property of ArtGalerie.
Users may not:
Upload offensive, illegal, or defamatory content
Infringe third-party intellectual property
Use the platform for fraud
Attempt to hack, reverse-engineer, or disrupt the website
Create fake accounts or impersonate others
Violation may result in account suspension or legal action.
ArtGalerie may suspend or terminate accounts if users:

Engage in fraud
Provide false or misleading information
Harm the platform or other users

ArtGalerie is not responsible for:
Damages resulting from artist or customer actions
Loss of profits, data, or business opportunities
